A famous guitarist who played for legendary rock bands Pearl Jam and the Red Hot Chili Peppers has been named in a wrongful death lawsuit filed in Los Angeles Superior Court in connection with his role in a fatal pedestrian accident earlier this year. According to NBC News, Josh Klinghoffer, a California guitarist with rockstar credit behind his name, was allegedly distracted by his cell phone while he was driving in Alhambra, California, and struck a pedestrian who was on his way to a local grocery store. Klinghoffer is said to have been driving an SUV at the time of the fatal pedestrian accident when he was distracted by his mobile device and blew through a marked crosswalk near Meridian Avenue and West Main Street in Alhambra. Klinghoffer is alleged to have killed 47-year-old Israel Sanchez, who was walking through the crosswalk on his way to the grocery store to make soup when he was hit by Klinghoffer’s SUV. According to the complaint filed in the wrongful death lawsuit by Sanchez’ daughter, Ashley Sanchez, Mr. Sanchez had followed the rules of the road prior to entering the crosswalk by ensuring traffic had cleared before entering the street and making sure to cross at the marked crosswalk. In addition, the lawsuit alleges that Klinghoffer did not apply the brakes when he plowed through the crosswalk and hit Sanchez. Of the terrible and senseless pedestrian accident, Sanchez’s attorneys noted that, “He did everything right looking for oncoming traffic and abiding by pedestrian signage, but tragically Mr. Klinghoffer, in a rush and on his phone, hit him fatally from behind with a large SUV. The loss and grief that the Sanchez family now faces is immense. We will not stop until there is accountability and justice for Mr. Sanchez and his family.”

Mr. Klinghoffer is said to have not shown remorse for the terrible killing, and did not contact the Sanchez family after the accident. Ashley Sanchez seeks a jury trial in the wrongful death lawsuit that she initiated in Los Angeles Superior Court, and compensation under California wrongful death laws, including funeral and burial expenses, medical expenses, pain and suffering, loss of companionship of her father, and attorneys’ fees. The lawsuit is pending and it remains to be seen whether Klinghoffer will be held liable for the tragic death of Israel Sanchez due to being distracted by his cell phone.
